NOTICE: Strict Auction Load-Out Schedule

Load-out will take place only during the following dates and times:

• Thursday & Friday, February 5–6 9:00 AM – 4:00 PM
• Monday–Wednesday, February 9–11 9:00 AM – 4:00 PM

Please adhere to these scheduled load-out times. Any items not removed by February 11 will be forfeited due to new occupants moving into the property. No refunds will be issued for items not picked up by the final load-out date.

Invoices must be paid in full immediately. Items will not be released until payment is received. Buyers are responsible for the disassembly and removal of all items. Inspection prior to bidding is both recommended and available. Buyers are responsible for all freight and handling costs.

Buyer’s Premium:
A 15% buyer’s premium will be applied to each item purchased.

All bids are final. All items are sold as is, where is.

Payment Terms:
Full settlement is due on the day of the auction or the following business day. Accepted payment methods include Cash, Cashier’s Check, Credit Card, or Wire Transfer payable to Henderson Auctions. Applicable taxes will be charged unless bona fide tax exemption is provided.

A 4% convenience fee will be applied to all credit card payments (MasterCard, Visa, American Express, and Discover). International credit cards are not accepted. International buyers must pay via wire transfer; a $50 international wire transfer fee applies.

Personal or company checks must be accompanied by a bank letter guaranteeing payment. Bank drafts will not be accepted.

Notice to Non‑U.S. Buyers: Purchasers without U.S. bank accounts must pay in U.S. funds via wire transfer. Some equipment may require modifications to meet import or safety regulations. Please consult your customs broker for details regarding export requirements.

Any invoice not paid within three banking days of the auction date is subject to 2% monthly interest, prorated daily beginning on the sale day.

Sales tax will be applied when applicable. If you are buying for a tax-exempt entity, please email the tax exemption form to auctionoffice@hendersonauctions.com.

You are legally obligated to pay for all lots you win. All sales are final and are not contingent upon financing. Please refrain from participating in any auction if you are unable to complete the purchase under the auction’s established terms.

Automatic Credit Card Charges: If the winning bidder has not made payment arrangements by the payment deadline, the credit card on file may be charged for all outstanding invoices, including a 4% credit card fee.

All litigation, claims, or legal proceedings arising out of or relating to this auction shall be filed and maintained exclusively in Livingston Parish, Louisiana.

Additional Auction Terms:
While descriptions are believed to be accurate, neither the auctioneer nor the seller makes any warranty or guarantee, expressed or implied. Pre-bid inspection is available and is strongly recommended. Henderson Auctions shall not be held responsible for advertising discrepancies or inaccuracies. Everything is sold ‘AS IS’ – ‘WHERE IS’ except as expressly made in writing. All sales are final. No warranties are made as to the merchantability of any items or their fitness for any purpose.

Sales Tax will be added to the purchase of all taxable items sold. Tax will be collected on the final bid amount plus any buyer’s premium when applicable. Dealers who purchase for resale must present their resale tax certificate to Henderson Auctions at the time of payment.

The AUCTIONEER or BID CALLER has the sole discretion to determine the final high bidder, and can, in his sole discretion, open the bidding, close the bidding, exclude bidder, recognize late bidder, reopen closed bidding, and reopen the bidding between tied bidders. Bidders have the opportunity, where available, to bid in person, absentee, by proxy, by telephone, or through online bidding platform(s) or other methods recognized by the auctioneer. Auctioneer reserves the right to bid on behalf of the owner when applicable.

Any notice of being the successful bidder or being outbid provided through online platform(s) or by any party other than the BID CALLER and Management for the AUCTIONEER does not constitute official notice. Official notice of award and confirmation that a sale has occurred will be issued only in the form of an invoice from the AUCTIONEER. AUCTIONEER has the right and sole discretion to amend or correct any invoice that is sent to a BIDDER in error.

General Terms:

• Photos shown on the website are meant as a representation; all items in the photo may not be included in the lot. Please read the lot description for specific items included with the lot.
• During a live auction using any online bidding platform, Henderson Auctions is not responsible for clerking errors. The Auctioneer calling the auction is the only person who determines who has placed the high bid and who is the winning bidder. This is not determined by the clerk for the online bidding platform. High bidders will receive an invoice from Henderson Auctions, not the online bidding platform. If you receive an email or invoice from an online bidding platform, please disregard this notice and call our auction office 225-686-2252.
• Some online bidding platform post-auction prices may not reflect the correct sold price as stated by the live auctioneer.
• Henderson Auctions disclaims all liability for any personal injury, property damage, or loss of any kind occurring on the auction premises, and all attendees enter the property at their own risk.
• All items are sold “as is, where is”, with no guarantees or warranties express or implied as to the usefulness of intended purpose or merchantability of said item(s).
• Pre‑bid inspection is strongly recommended and available to all bidders.

• All claims or disputes or legal actions by any party to this agreement must be filed in the Circuit Court of Livingston Parish, Louisiana, and all legal matters contemplated in this agreement will be governed by the laws of the State of Louisiana and that jurisdiction.
